If a spouse does not exist or survive the deceased, the benefit would then go to the next of kin, which includes any children of the deceased. If neither a spouse or children exist or survive the deceased, those entitled to the compensation will follow a priority list that is established by law. This list consists of any surviving parents, siblings, nieces or nephews.
